Privacy Policy

The Licensor is committed to protecting the privacy rights of the end users of its software, “Sedstart,” and ensuring that the Licensee follows strict privacy standards. By using Sedstart, the Licensee agrees to comply with this Privacy Policy. Any breach of this Privacy Policy by the Licensee will result in the Licensee being solely liable for any legal or privacy-related consequences arising from such breaches.
This Privacy Policy applies to all Licensees, users, and end users interacting with the software. It governs the collection, use, storage, and protection of data within the Sedstart platform. This Privacy Policy is drafted in accordance with and in compliance with the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”), to the extent applicable, to ensure the protection of personal data and privacy rights of individuals.

1. User Data Collection

The software may collect certain types of data directly from end users to enhance functionality and ensure smooth operations. This includes:

a. Personal Data: Name, email address, phone number

b. Audit Trail Data: Details of user actions within the software (e.g., login times, access logs)

No sensitive personal information or payment data is collected unless explicitly stated.

2. Data Usage

The data collected will be used strictly for the following purposes:

a. Product Analytics: To improve software functionality, user experience, and performance

b. Product Improvements: Details of user actions within the software (e.g., login times, access logs)

Data Sharing: The Licensor will not share user data with third parties under any circumstances unless required by law or authorized by the user.

3. Data Storage and Security

User data will be stored securely using either cloud-based services or on-premises servers, depending on operational needs.
The following security measures are in place to protect user data:

a. Data storage behind private VPCs (Virtual Private Cloud)

b. Restricted, role-based access to sensitive data

c. Regular security audits and encryption to safeguard data

4. User Rights and Account Management

End users have the following rights regarding their personal data:

a. Access and Modification: Users can access and modify their data at any time through role-based controls.

b. Data Deletion: Users can delete their accounts, and upon unsubscribing, primary Personally Identifiable Information (PII) will be stored for six (6) months, after which it will be permanently deleted from the system.

5. Cookies and Tracking Technologies

The software may use cookies and tracking technologies, such as web beacons, to improve user experience.

a. Cookie Preferences: Users will not have the option to manage cookie preferences.

b. Purpose of Cookies: To collect information about user interactions, analyse trends, and track product usage patterns.

6. User Eligibility

The software is intended for users who are 16 years of age or older. It is not designed for children under 13, and the software does not collect information from users below this age threshold.

7. Prohibited User Conduct

Users and Licensees are prohibited from engaging in the following actions:

a. Unauthorized Access: Attempting to hack, gain unauthorized access, or disrupt the software through malicious means, including but not limited to DDoS (Distributed Denial of Service) attacks.

b. Sharing Access: Sharing user credentials with unauthorized individuals.

8. Dispute Resolution and Jurisdiction

In the event of any dispute, this Privacy Policy will be governed by and construed in accordance with the Dispute Resolution Clause 6 of the Software Development Agreement.

9. Third-Party Integrations

The software may integrate with the following third-party services for enhanced functionality:

a. Browser Stack – For browser testing

b. Mail Trapper – For email testing

c. SendGrid – For sending notifications

No additional third-party licenses or terms will apply beyond those mentioned above.

10. Data Breach Protocol

In the unlikely event of a data breach, the affected users will be notified promptly through support mail. The notification will include details of the breach, remedial measures being taken, and any steps users should take to protect their accounts.

11. Licensee Liability for Privacy Breaches

a. The Licensee must adhere to this Privacy Policy and ensure that end users’ data is protected while using the Licensor’s software.

b. In the event of any breach of privacy caused by the Licensee’s actions or negligence, the Licensee shall be solely liable for any resulting damages, penalties, or legal consequences. The Licensor disclaims all liability for breaches or misuse of data caused by the Licensee or its end users.

c. The Licensor expressly states that the Software does not contain any embedded links to third-party websites or services. In the event that any user accesses external websites, links, or services outside the scope of the Software, such access shall be at the user's sole discretion and risk. The Licensor does not endorse, control, monitor, or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services accessed by the user independently of the Software. Users are strongly advised to review the privacy policies and terms of service of such third-party websites prior to providing any personal information or engaging with such services. Under no circumstances shall the Licensor be held liable for any loss, damage, or breach of data arising from the user’s interaction with external third-party platforms.

By using the software, the Licensee and end users agree to be bound by the terms of this Privacy Policy. Continued use of the software following any changes to the Privacy Policy constitutes acceptance of those changes.
